Important: Everlyst is a tool that acts on your behalf via Etsy's API. You are responsible for ensuring that any listings created or modified through Everlyst comply with Etsy's policies and seller guidelines.

All fees are non-refundable except where required by applicable law or at our discretion. We may change pricing with reasonable advance notice to active subscribers.
Your subscription will renew automatically unless cancelled before the next billing period. You may cancel at any time through your account settings.
You retain ownership of all listing data, content, and intellectual property you create or manage through Everlyst. By using the Service, you grant us a limited license to process your data solely to operate and provide the Service.
We do not claim ownership over your shop data, listings, or any content you upload. We act as a data processor on your behalf with respect to information retrieved from Etsy's API.
Everlyst's functionality depends on Etsy's API. We are not responsible for interruptions, limitations, or changes to the Etsy API that affect the availability or functionality of the Service. Etsy may change, restrict, or discontinue API access at any time, and we cannot guarantee uninterrupted operation as a result.
We will make reasonable efforts to communicate any material API-related disruptions that affect your use of Everlyst.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, uninterrupted, or free of harmful components.
To the maximum extent permitted by applicable law, Everlyst shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of revenue, data, goodwill, or business opportunity — arising out of or related to your use of the Service.
Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the total fees paid by you to Everlyst in the 12 months preceding the claim, or (b) $100 USD.
You may stop using the Service at any time. You may delete your account by contacting support@everlysthq.com.
We may suspend or terminate your access to the Service at our discretion, including for violations of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately.
Sections that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) will survive.
We may update these Terms from time to time. We will provide notice of material changes via email or a prominent notice in the Service. Continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.
